Abstract

[Autom. eng. transl.] According to the sentence of 22 January 2020, n. 545 of the Council of State, the principle of alternation between judicial appeal and extraordinary appeal implies that the chosen venue for the contestation of the presupposed deed also attracts the appeal for invalidity derived from the consequential deed, which therefore cannot be proposed in a different venue. Furthermore, Section II stated that the demolition nature of the extraordinary appeal does not allow to propose the compensation claim with this remedy, which however is admissible in court even if the appellant has challenged the presumed act in an extraordinary session .
