Abstract

[Autom. eng. transl.] A short note on the distinction between dismissal and suspension of the directors of a limited liability company. The Tribunal of Milan rejected a motion for the directors, noting that the law provides for a dismissal only. The Tribunal should have considered the substance of the claim rather than relying on a strict interpretation of the language of the claim
