Abstract

[Autom. eng. transl.] THERE. provides a philosophical foundation for the thesis according to which legal reasoning must be understood as practical reasoning 'in situation', which proceeds by elaborating 'cases' rather than applying 'rules'. The "dissidio" (différend) theory of J.-F. Lyotard, the heterogeneity of the "cities" (cités) (which constitute the different principles of justice) of L. Boltanski and L. Thévenot and the analysis of " reflective judgment "by I. Kant offer the philosophical basis for reflection. THERE. it follows the different techniques of application of the Kantian reflective judgment model, which consists in judging without criteria but not without a regulatory horizon. Aristotelian prudence and equity, analogy and abduction offer examples of the heuristic role of literary fiction. In the concluding part of the text, the A. recalls some concrete experiences of application of the literary method in the training of jurists.
