Abstract
[Autom. eng. transl.] The work intends to define if and to what extent a criminal responsibility of Bishops can be configured according to Italian law, assuming a broad examination of the forms of responsibility of the same in canonical matters, with regard to facts put in place by clerics subjected to their jurisdiction . In particular, the responsibility for omission is discussed, excluding the configurability of a "guarantee position" that assumes general importance pursuant to art. 40, co. 2, Criminal Code Parallel to this, the problem related to the scope of the Bishop's obligations with respect to state investigation activities is addressed. In this context, we highlight the canonical duties incumbent on the Bishops for the prevention of illegal conduct of clerics and their eventual reiteration.
