Abstract

[Autom. eng. transl.] The volume analyzes the main changes that have occurred in recent years in the field of labor law, using the burden of proof as a key to understanding. This is in order to verify the degree of effectiveness that the remodeling of the protections achieves on a substantial and remedial level. The transversal nature of the institute allows, in fact, to recognize in the burden of proof a tool that allows, on the one hand, to assess the rigorous definition of the substantive case; on the other, a coherent systematic reconstruction of the same case; from yet another, and consequently, to verify the effective enforceability of rights in court, as well as the adequacy of the remedies and safeguards set up. Following a purely case-based approach, the treatment of the profiles considered is divided into two stages: one, aimed at setting the issues in general terms and at bringing out the specialty of the probative rule in the context of labor law; the other, aimed at testing the theoretical and practical implications of the burden of proof in relation to the cases of greatest interest and relevance, also through the detailed reconstruction of the various interpretative solutions proposed.
