[Autom. eng. transl.] The work analyzes the origin and fundamentals of the notion of jurisdiction understood in a dynamic sense and of the excess of jurisdictional power developed by the Court of Cassation in a recent jurisprudential orientation, and notes that this is an interpretation without a legislative and contrasting foundation with the art. 111 of the Constitution
