Abstract
The article aims at analysing the relevant holdings of the Italian Supreme Court on
vehicular homicide (art. 589-bis c.p.); specifically: its legal qualification, tempus
commissi delicti and interactions with the offences provided by the Road Code. In
addition, the work then examines the decision recently delivered by the Italian Constitutional
Court (n. 88/2019), which confirmed the constitutionality of the law n.
41/2016 and, in particular, of the article on accidentalia delicti (art. 589-quater
c.p.), with specific reference to the principles of reasonableness, proportionality and
rehabilitation.
