Abstract

[Autom. eng. transl.] The short essay concerns theoretical problems of considerable importance. It is stated that the proritarian function of the criminal trial is not to allow the application of a penalty, but to make truth about the crime. A truth that is not different from the real truth, but such, only, that its research meets precise guarantee limits: unsurpassed in the non-dialogical context of a criminal justice that remains anchored to remuneration settings. For this reason, the possibility of making the approach to truth in criminal law more authentic, with positive effects in terms of prevention that is not merely symbolic of crimes, is evident in the opening to profiles of dialogued justice, as happens in the emblematic case of criminal mediation.
