Abstract
[Autom. eng. transl.] Starting from the judgment of the Tar Valle D'Aosta n. 2 of 2019, the contribution deals with the complex issue of the relationship between the protection of the constitutional rights of people with severe disabilities (in the case under examination, a minor student) and financial sustainability of the services dedicated to them by the public administration. Through an articulated motivation, the administrative judges affirm the financially unconditional nature of the right to the life project of the disabled person, specifically provided for by the regional legislation of Valle d'Aosta. The decision therefore confirms, although not recalling it, the principle affirmed by the Constitutional Court with sentence n. 275 of 2016, according to which "it is the guarantee of the incompressible rights that affect the balance sheet, and not the balance of this which conditions its duty to pay".
