Abstract

[Autom. eng. transl.] Starting from the evaluation of the outcome of the constitutional referendum held in June 2006, the essay aims to reflect critically on the issue of the organic reform of Part II of the Constitution, posing the problem of the intrinsic connection between the system of rights and the discipline of the constitutional organization. The latter, structured in the light of the division of powers - a principle inextricably intertwined with the evolution of modern constitutionalism - appeared threatened by the considerable concentration of powers in the hands of the Prime Minister, with potential, significant repercussions on the preservation of the balance between weights. and counterweights, a typical feature of the contemporary constitutional state.
