Abstract
[Autom. eng. transl.] The work highlights the validity and limits of the main strands of penal abolitionism. The priority is the need to overcome the traditional view of the relationship between crime and punishment, under which the latter, beyond the purposes attributed to it, is understood as a "negative analogue" of the unlawful act. On the basis of a critical analysis of traditional preventive models, and having ascertained the inadequacy of the mere reference to the paradigm constituted by "minimum criminal law", criteria are outlined for an effective reform of the penal sanction apparatus.
