[Autom. eng. transl.] Judicial epistemology studies the methods and validity of knowledge in the judicial reconstruction of the fact. Therefore, it particularly concerns the quaestio facti. But the indissoluble link between the latter and the quaestio iuris cannot be ignored. The jurisdiction of the Court of Cassation may also be based not on a separation between factual and legal questions, but on the prohibition on carrying out probative activities or on the limitation, for example, of the procedural violations it can examine.
