Abstract
The contribution analyzes the protections of the right to property, of which a certain profile of weakness is highlighted, also linked to cultural or ideological preconceptions. Paradigmatic is the case of illegal occupations of real estate. In particular, we focus on some judgments on the merits and of the Supreme Court that address the issue of State liability for not preventing or effectively counteracting the illegal occupation of real estate.
