Abstract
[Autom. eng. transl.] After having clarified that a trial can be called circumstantial when it is based not on evidence in the strict sense, but on clues, we illustrate the triple development of the evidential evaluation in its atomistic, holistic and overall profiles. The characteristics of the clue are then identified, as it is required that they are serious, precise and consistent in order to be used for the judge's decision. Finally, the requirements that the motivation of the Supreme Court must possess when judging on the regularity of an evidential process are set out.
