Abstract

[Autom. eng. transl.] The study deals with the complex issue of recidivism, a hybrid and protean nature institution, touched by numerous legislative reforms since the Rocco Code of 1930 came into force to law n. 251 of 2005. The Author highlights how, following the recent reform, to make the discipline of recidivism more severe, not only its mandatory nature, the rigidity of the increase in punishment and sometimes its greater consistency compete, but also a series of new penal effects of the conviction, which affect four other institutions of the penal code: the general extenuating circumstances, the heterogeneous concurrence of circumstances, the continued crime and the limitation period.
