Abstract

[Autom. eng. transl.] The text highlights - on the basis of a reflection on the status of the good life in the constitutional framework - how the unavailability of the conscientious objector to act against a human life cannot be considered in contrast with the founding principles of the legal system. Therefore, the direct derivability of the right to conscientious objection based on the aforementioned good is affirmed. That being said, the areas in which problems concerning the conscientious objection in the health sector are today are considered.
