Abstract

This work returns to the debated topic of equal treatment between citizens and foreigners in relation to the provision of services and social benefits, first of all focusing on the most recent developments in constitutional jurisprudence and on the limits which the legislator's discretion may encounter when introducing requirements additional costs to be paid by the foreigner to enjoy certain benefits. European Union law can, in turn, provide an important contribution to strengthening the rights of third-country nationals, thanks also to the direct effect recognized to the prohibitions of discrimination contained in some directives.
