Abstract

[Autom. eng. transl.] The paper takes its cue from the Constitutional Court's ruling n.115 of 2011 to examine the recent trends in matters of ordinance powers. The rule of art.54 of the tuel on ordinary trade union ordinances ultimately results in the legalization of governmental practice regarding civil protection ordinances, which from emergency instruments tend to become ordinary administrative tools. These tendencies, however, could not fail to meet the censures of the Consulta, given that they are likely to result in an undue reinforcement of the chief executive, and, therefore, in an alteration of the form of government provided for by the current Constitution.
