Abstract

[Autom. eng. transl.] Article. 23-bis of the DL n. 112/2008 introduced a completely new discipline of the government system of local public services of economic importance. One of the connoting features of the sector reorganization operation was constituted by the attribution to the Government of the Republic of the power to regulate numerous and significant areas of the subject, through secondary sources (delegation regulations). The work proceeds to verify the compatibility of this choice of the legislator with the constitutional norms of reference, especially the provision of art. 43, Const.
