Abstract
In the context of reflection focused upon art. 4 of the Worker’s Statute
before and after 2015, the essay carries out a comparison with the similar
provision contained in the German Act on workplace order. In the light of the
most recent evolutions of the two legal systems, comprising the so called
“Transparency Decree” (legislative decree n. 104 of 2022), the author points out
the different level of employee representatives involvement, with the German
model further supporting strong participation, whereas the Italian one seems to
drive towards an approach based on mere transparency, inevitably less incisive.
