Abstract
[Autom. eng. transl.] Fifty years after the Workers' Statute and in the light of the constitutional principle of trade union freedom, the article addresses the main issues in terms of trade union representation that have long been posed to the actors of the Italian trade union relations system and to political forces. THERE. demonstrates how these problems in the most recent phase have been made more acute by the paradox generated, on the one hand, by the constant expansion of the area of rights, protections and powers that the State has progressively placed in the hands of trade unions qualified as "representative" and on the other hand, from the simultaneous weakening of the concepts and selective criteria applied. Furthermore, taking into due consideration the important experience acquired by the reforms regarding trade union relations in the public sector, the progress of the process of implementation of the system for measuring and certifying "trade union representativeness" provided for by the Interconfederal Agreements for the private sector entered into in the past decade.
In the concluding part, the author makes some proposals for the reorganization of the relevant legislation.
