Percorsi di verità nelle società multiculturali

[Autom. eng. transl.] For years the criminal law doctrine deals with the problems that arose because of the multiculturalism of Western societies that criminal law must resolve. The theme interferes with another topic of primary importance in the field of criminal sciences: the extent to which it is possible to reach the truth through the process. Suffice it to think of culturally oriented crimes that, considered illicit in the host legal system, are imposed or made optional in the culture to which the offender belongs. It is clear that at the base of the two judgments there are two different ideas of man and of the world, two truths which are often quite contrasting. How then can we recognize cultural diversity? On the basis of which parameter, given that the truths appear to be apparently irremediably relative? Starting a journey of truth in multicultural societies means first of all identifying precise meanings for the concepts used, first of all that of "cultural belonging". Only in this way is it possible to assess its relevance within the legal system and establish whether to implement some form of recognition in the penal system, abandoning ideological approaches.
