Per un diritto amministrativo dell’antimafia: considerazioni sul d.lgs. 6 settembre 2011, n. 159

[Autom. eng. transl.] Legislative decree 6 September 2011, n. 159 (so-called anti-mafia code) should represent a valid and complete reference text, so as to simplify the activity of the interpreter. The author questions the actual achievement of this objective, focusing on some of the most relevant provisions in the field of administrative law and on the problematic coordination with the code of contracts (Legislative Decree 12 April 2006). In this framework, the system of information, the profiles of jurisdiction in the event of withdrawal and withdrawal of the relationship with the company receiving the disqualification information, the different hypotheses of responsibility of the administration are the topics chosen for a comparison with the previously applicable discipline and with the solutions developed by the jurisprudence.
