Translated title of the contribution: [Autom. eng. transl.] Canonical penalty and protection of the minor

Research output: Chapter in Book/Report/Conference proceedingChapter

[Autom. eng. transl.] The contribution primarily reflects the innovative role that the prediction of sexual abuse crimes against minors within the canonical penal system represents. On this basis, it analyzes the limits of canonical penalties in relation to the prevention and management of the same crimes, but also illustrates the effort adopted to activate, within the ecclesial center, valid primary prevention initiatives with regard to this matter. The need for an organic vision of the canonical sanctions is affirmed, so that they can comply, not only formally, for the purposes of protecting the victims, repairing them, as well as rehabilitating or treating the condemned. The analysis extends to the consideration of the serious deficiencies found regarding the procedural guarantees in the canonical penal field, as well as to the relationship between the canonical procedure relating to the crimes in question and the activation, with respect to them, of the state judicial process. Attention is paid to the comparison with the legislation concerning the aforementioned crimes provided for in the Vatican state system.
