Abstract

[Autom. eng. transl.] In the context of an advanced civil law manual, which aims to combine informative exposure with a critical-reconstructive approach and is aimed in particular at the preparation of the competition in the judiciary and the specialized operators of the law, the chapter deals with the subject of the commission agreement and of the march pact. In particular, he examines the rationes and symptomatic figures of the first. Of the second he deepens the notion, doubting that the mechanism of restitution to the debtor of the surplus of the value of the asset with respect to the amount of the debt is in itself suitable to exclude the reasons of illegality placed at the base of the first, to then frame three of the figures recently governed by special legislation which seem to constitute typologies of the Marciano pact.
