Abstract

It is commonly stated that the principle of equality also applies to foreigners, in relation to inviolable rights, as a result of a systematic reading of Articles 2, 3 and 10 of the Constitution. However, the right of entry into the territory of the State and political rights remain excluded. The affirmation deserves a deepening, under various aspects: to evaluate the openings regarding the attribution of the right to vote also to foreigners; to verify, then, the actual enjoyment of freedom and guarantees, constitutionally recognized to all individuals; in relation, finally, to those social benefits, whose provision in favour of the foreigner is often subject to additional conditions. In this regard, the contribution from European Union law is of great interest.
