Abstract
This essay explores the relationship between the legal category of obligation and family obligations, conceptualizing family solidarity obligations as duties to protect. It examines key aspects of the regulation of these obligations, focusing particularly on the mechanisms of astreinte and the external implications of family duties. The analysis addresses complex issues, including responsibility for procreation and cross-border surrogacy, balancing the concrete interests of the child with the principle of legality, and proposing a potential resolution to this challenging dilemma. Lastly, the essay delves into a pressing issue of mandatory significance concerning the de residuo communion.
