Abstract

[Autom. eng. transl.] In 1802, at the time of the constitution of the Italian Republic, two models of local administration were present in the institutional engineering, the French publicist one and the late Habsburg-Lombard one, together with the fundamental principles that inspired them: the one of the citizen equal before to the law of revolutionary matrix, the other of the contributing owner of a physiocratic matrix. Melzi, vice-president of the Italian Republic, tried to reconcile them both: the Lombard model, in particular, based on the economic interest of the esteemed owners, could in his opinion guarantee the municipal councilors all the attachment to the public interests to which the their interest as esteemed tax payers. About a year later, in commenting on the law of 24 July 1802 on local administrations, the head of the Commission appointed by the Minister of the Interior Villa also felt the need to clarify the new meaning of the municipality that was underlying it, which was in good shape still part of the Teresian municipality. .
