Abstract
[Autom. eng. transl.] The rules that occurred during the trial that provide for the retroactive application of a sanctioning treatment more favorable to the perpetrator of an administrative offense must also be applied ex officio, therefore even when the interested party has not formulated a specific reason for appeal on the determination quantity of the sanction, since the purely public nature and purpose of the favor rei principle must prevail over the procedural preclusions provided for the appeals.
