Abstract
The essay comments on a decision of the Italian Supreme Court (Corte di Cassazione) related to the proof of causation in a case of medical malpractice. The note takes into consideration the causal nexus in a case – such as this – of failure to act and highlights the 'beyond any reasonable doubt' standard of proof.
