Abstract
[Autom. eng. transl.] Article. 5, paragraph 9, decree 13 May 2011, n. 70, converted with changes to l. 12 July 2011, n. 106, which allows the regions to foresee an additional volume of the previous one, is an exceptional and derogatory provision and therefore strictly interpreted: the benefits provided by it are allowed only if they are aimed at rationalizing the existing building stock or promoting or facilitating redevelopment of degraded urban areas. The institution of silent assent in the building sector is applicable only to cases of restricted activity.
