[Autom. eng. transl.] According to the pronouncement of the plenary meeting under discussion, the anti-mafia interdictory information determines a particular form of incapacity ex lege, partial (as it is limited to specific legal relations with the public administration) and tendentially temporary, with the consequence that the subject, person physical or legal, it is precluded from having relations with the public administration related to the provisions of art. 67 law 6 September 2011 n. 159. By reason of this, according to the ruling, the art. 67, paragraph 1, lett. g), d.leg. 6 September 2011 n. 159 must be understood to preclude the payment, in favor of the recipient of anti-mafia interdictory information, also of sums due by way of compensation for damage. In the contribution, however, it can be observed that some arguments lead to the solution opposed to the one accepted by the plenary meeting, ie they confirm the solution of not including the sums due by the administration as compensation for damage within the scope of application of art. 67 of the code.
