Abstract
[Autom. eng. transl.] The contribution deals with the issue of the pre-contractual liability of the public administration, with specific reference to the hypothesis in which the incorrect behavior of the latter occurs before the publication of the notice.
Furthermore, the note deals with the age-old question of the nature of this responsibility, in the light of the pronouncement of the plenary meeting of the Council of State no. 5/2018.
