Abstract
[Autom. eng. transl.] The Court of Cassation, in the judgment in question, clarifies that for the ascertainment of the crime of refusing official duties in the performance of the "118 Service" it is irrelevant that the death of those requesting assistance is practically inevitable . The function of the intervention of the "118", in fact, must not be limited to the functional aids to the survival of the patient, but also to those no less important than a "therapeutic presence" or "soothing of pain". The obligation to intervene, aimed at ensuring the patient health care, concerns both physical and mental health and also includes the need to alleviate the atrocious suffering of a terminally ill patient.
