Abstract
[Autom. eng. transl.] The note examines the Cass judgment. civ., section un., 9 January 2010, n. 329 according to which the dispute concerning the contestation of the legitimacy of the results of the tender procedure announced by the local public transport concession holder for the leasing of bar spaces inside the underground stations rests with the ordinary judge, given that the concession act does not it has no relevance for the third party whose relationship with the concessionaire results in a contract governed by private law
