Abstract
[Autom. eng. transl.] Neuroscientific techniques are beginning to appear in criminal proceedings. The author analyzes the areas of potential procedural use of these techniques in the investigative phase, highlighting the frictions that can occur regarding the respect for the fundamental rights of the people involved, and in particular of the accused. The final evaluation entrusted to the judge must inevitably take into account these difficulties of use for the purposes of the decision, on the basis of the most recent acquisitions regarding the evaluation of the probabilistic scientific proof.
