Abstract

[Autom. eng. transl.] The problem from which the research moves is the persistent violation of the prohibition of bis in idem in the Italian legal system, by reason of the consolidated jurisprudence for which only in the Schengen area, or in the presence of international agreements, is the prohibition of second judgment against a natural or legal person. A new rule is therefore necessary for the renewal of the judgment in idem overcoming the old tool of art. 11 of the Criminal Code and the provision, born already obsolete, of art. 4 of Legislative Decree no. 231/2001. In the essay reform proposals are formulated aimed at reaffirming principles increasingly valued also by constitutional jurisprudence
