Abstract

[Autom. eng. transl.] The text highlights the incompatibility of the death penalty with respect to the constitutional vision of justice and the foundations of democracy, as well as with respect to a non-superficial model of prevention. It also describes the reasons why the death penalty cannot be traced back to the sphere of legitimate defense, nor in any case justified from the ethical-philosophical or religious point of view. It is stated that to reinforce the authoritativeness of the norms it is essential, rather, the recovery of the condemned by a penalty seen not as an inflicted suffering, but as a means for social reintegration. It follows that, in addition to encouraging the renouncement of the death penalty, it is necessary to promote a diversification of criminal penalties, such that recourse to prison is understood as a "extrema ratio".
