Abstract

[Autom. eng. transl.] The volume deals with the developments that EU law has registered, in terms of legislation and case law, in the establishment of the single market and in the realization of the freedoms of movement within it. For each chapter the authors have followed a unified scheme, which consists of a brief introduction to the topic under discussion, which is accompanied by the citation of the most significant points of the relevant materials (eg TFEU articles, Union legislation, Court rulings of justice) and some verification questions. The book deals first of all with the regulation of trade in goods with third countries and in the internal market: in the first chapter it deals first of all with the EU customs union and the related uniformity of treatment of trade with third countries; he therefore dwells on the freedom of circulation of goods in the internal market, namely in particular on the elimination of fiscal, technical and regulatory barriers to trade, while respecting the margins of regulatory autonomy of the member countries. The chapters on European citizenship and the free movement of workers are at the center of the volume. In particular, the second chapter analyzes the relations between European citizenship and that of the Member States, as well as the civil and political rights deriving from European citizenship. The third chapter, on the other hand, concerns the free movement of workers within the European Union and examines the conditions of access and employment, the rights of the worker's family members and the provisions on social security. The volume closes with the three chapters on the subject of freedom of establishment, freedom to provide services and free movement of capital and payments. In particular, the three chapters analyze the scope of application of the three freedoms, the relative negative and positive integration obligations borne by the Member States, as well as the exceptions to the obligations in question, also addressing the issues of abuse of the right of Union and foreclosure of the legislative power of Member States following the action of the EU legislator.
