Abstract

[Autom. eng. transl.] The subject of prohibited evidence has recently been toned to be examined by both the Court of Strasbourg, which has expressed itself on the controversial relationship between illegitimate search and consequent seizure of the body of the crime, identifying the parameters of the trial fairness judgment , both by the Constitutional Court, which, while denying the derived unusability, seems to admit the operation of the nullity derived in the evidentiary sphere
