Abstract
The contribution analyzes how the condition of gambling addiction of the accused can,
first, influence the criminal trial (during which it the delicate moment of ascertaining
the imputability comes into play) and his conclusion, as well as, then, affect the method
of execution of the sentence, leading to favoring alternative measures to detention, in
order to safeguard the fundamental right to health of the convict
