Abstract
[Autom. eng. transl.] The essay focuses on some significant evidence that private law has faced in recent decades, up until today. Not only the eruption of the Constitution and European law, but also the discoloring of the traditional boundaries between public law and private law and the fascination of interpreters for some figures of elsewhere - but without plausible anchoring in the legal system - such as trusts and so-called punitive damages. In the background the systemic question is still that of the sources of law.
