L'ombra lunga della tradizione. Cultura giuridica e prassi matrimoniale nel Regno di Napoli (1809-1815)

This study considers the enforcement of the Code Civil in the Kingdom of Naples (1809-15) and the analysis of judgments passed by Neapolitan Courts. The Napoleonic Code Civil provided two innovations unknown to the Neapolitan people: civil marriage and divorce. The study investigates how Neapolitan judges and barristers reacted to these innovations. A systematic search in archives revealed that, during the French domination, lawyers probably partially accepted the French model. The object of this study is to investigate how the Code Civil was nationalized by Neapolitan judges, using the judgments found in the Archives of cities of Southern Italy. Besides, this study aims at investigating the position of judges, establishing if they were influenced by French judgments, or if they were able to create a new and original stylus iudicandi. Finally, this study aims at analyzing the relations between the Code Napoléon and others sources of law.
