Abstract

Intervening in a case of unlawful occupation of another person’s real estate, the “Sezioni Unite” of “Cassation Court”, with their nomofilactic authority, seek to unravel the contrast that has arisen between the simple sections regarding the nature and proof of compensable damage, drawing an “intermediate” solution, which, while denying citizenship to the figure of damage in “re ipsa”, seeks to facilitate the procedural profile of the injured party, through the formula of“normal”or“presumed” damage.
