Abstract
This study investigates the regulatory and jurisprudence changes regarding the I.S.E.E. (Equivalent Economic Situation Indicator), disciplined by the d.p.c.m. n. 159 of the 2013. It examinates the sentences of Council of State n. 838, 841 and 842/2016 and
the art. 2-sexies of the law decree n. 42/2016. Moving from the thesis of the unconstitu-tionality of this law, as a result of the infringement of the Article 77 of the Italian Constitution, a coherent programme of legislative reforming of I.S.E.E. is required.
