[Autom. eng. transl.] The paper attempts to reconstruct the obligatory relationship by enhancing the creditor's interest even in line with the dismissal of the jurisprudence from the controversial distinction between means and result obligations. From this point of view, the distinction between contractual and non-contractual liability emerges and the different way in which the diligence category is detected. Discusses the rules on the burden of proof and on indemnifiable damage. Finally, it distinguishes between obligation in its proper sense and guarantee.
