Abstract

[Autom. eng. transl.] The volume deals with the European Citizens' Initiative (ICE), an institute introduced into the European Union legal order by the Lisbon Treaty and which is effectively applied starting April 1st 2012, after its adoption by the legislator Union of the regulation which specified the conditions and procedures for the presentation of an ICE. The objective is to verify, from a methodological legal perspective, whether the ICE is a suitable instrument for strengthening the democratic legitimacy of the Union. This objective is pursued through an analysis aimed at evaluating the ICE in light of the institutional context in which it is inserted, and which is divided into four passages, corresponding to as many chapters. First, the overall picture of the Union's democratic credentials is examined, in particular in light of the "Provisions relating to democratic principles" introduced in the Treaty on European Union (TEU) by the Lisbon Treaty. Secondly, the current legal regime of the ICE is analyzed, as it results from the art. 11, par. 4, TEU and the implementing regulation at the applicable time, drawing indications on the nature of this institution and at the same time trying to highlight the critical points. Thirdly, we focus on the applicative practice, with specific reference to the one concerning the two issues of greatest interest from a legal point of view, namely the registration of ICE proposals and the follow-up to be given to an ICE that has collected. the minimum number of signatures. Finally, the innovations introduced by the recent reform of the implementing regulation, which will be applied starting from 1 January 2020, are evaluated. This analysis makes it possible to appreciate the added value of ICE compared to the other instruments of participatory democracy envisaged in the Union , but also to note that, to date, this institute has struggled to realize its potential. On this basis, we therefore come to formulate, in the conclusions of the work, some proposals on the methods by which to pursue a full appreciation of the ICE.
