Abstract

The author comments on the ECJ decision 15 January 2014 (case association de médiation sociale), which dealt with the calculation of the employees threshold for the application of the European rules on the employees' information and consultation rights. Though substantially agreeing with the decision of the court, the author criticise the tendency of the European jurisprudence to narrow the freedom of member States in the conduction of their social policies.
