Abstract

[Autom. eng. transl.] During the last academic years we have been called, first at the University of Pavia and today at the Catholic University of Milan, to hold a course dedicated to the study of the discipline, almost always of community origin, on asymmetrical bargaining between companies or between professionals and consumer. The practical need to ensure our students a reference text, endowed with a certain synthesis but which aims at soliciting the critical reflection of the reader, is at the origin of the effort, which we trust was not in vain, which led us to write this volume. The bibliography dedicated to the asymmetrical contract is indeed very large: there are countless monographs - as well as the items of scientific non-fiction - and there is no lack of manuals and treatises with a notable critical and informative study. To these "noble" tools of scientific reflection in our fields of discipline, it seemed useful to us to add, also for the highlighted educational purposes, a volume with a more institutional focus which also illustrates in an organic and analytical way the various disciplines of the asymmetrical consumer contract and business. This is a work in which we privilege a line of investigation aimed at highlighting - also for differentiam - the relations of these recent disciplines on the common law of contracts, which students learn during the first year private law institutions. In the deep conviction of the need, for the interpreter of "European contract law", of that systematic awareness that is the only tool for a non-occasional and isolated reading of such a jagged legal source discipline. The hope is that this approach will be able to satisfy not only the immediate university teaching needs - of those approaching the subject for the first time, with the intention of looking up from the civil code and starting to measure themselves with the " new contract law ”- but also the expectations of those who, more mature, approach the sector of asymmetrical bargaining in more problematic terms, aiming to place the special disciplines in that context of systematic coherence that has been evoked. Then the first edition of this work comes to light, for the critical rereading of which we sincerely thank our younger colleague Dr. Luigi Regazzoni, who shares with us the teaching commitment in the courses of the Catholic University.
