Abstract
[Autom. eng. transl.] The contribution analyzes the category of imputability, starting from the statute traditionally assumed in the penal code of 1930 and then deepening the element of mental illness. After reconstructing the interpretative contrasts that have occurred in the definition of which pathologies could correctly fall under the concept of mental illness, the contribution examines the most recent reform proposals regarding Articles 88 and 89 of the penal code.
